Terms and Conditions of Sale of the Delices Low Carb website specialising in the sale of sugar-free products

Hereinafter referred to as: "the Seller"
ON THE ONE HAND
AND any person placing an order via the website: www. deliceslowcarb.com: "the Site"
Hereinafter referred to as "the Buyer" or "the Customer"
ON THE OTHER PART
Which have previously set forth the following:
These General Terms and Conditions of Sale: "GTC" applies to any order placed on the Site. The relationship between the Seller and the Buyer is exclusively governed by these GSC excluding any other condition or document of any kind.
The Seller reserves the right to adapt or modify them at any time. If applicable, the new GTCs will be those in force on the day of the order.
Furthermore, placing an order on the Site directly implies the Buyer's adherence to these GTCs without any reservation.
Therefore, the subject matter of this contract is as follows:
1/ Orders
Orders placed on the Site are recorded as soon as the Buyer validates the order, which will be made definitive once it has been confirmed by our company to the e-mail address that the Customer has provided. After validation and payment of the full price, no order may be modified in any way whatsoever. This validation will result in the acceptance of these GTC and the renunciation of its own conditions of purchase or other provisions.
The SARL REGIME CRETOIS also reserves the right to cancel or refuse any order from a Customer with whom a dispute relating to the payment of a previous order would be in progress or any other litigious reason.
2/ Availability of products and quantity ordered
The products and baskets marketed on the Site are those visible on www.deliceslowcarb.com within the limits of available stocks. In the event of temporary unavailability, the REGIME CRETOIS company, which specialises in the sale of sugar-free products, reserves the right to process the order with a delay of one additional week.
The unavailability of products is indicated on the Site. If the unavailability occurs after the Buyer has placed the order, the Buyer will be informed by e-mail or telephone of the products that are out of stock. The Buyer will then have one working week (excluding weekends and public holidays) to request the cancellation or exchange of his/her order by contacting Customer Service. ( 9 ). After this period, without a response from the Customer Service, the order will be sent to the Buyer with the available items and only these will be invoiced. The reimbursement of an order cancelled by the Buyer because of out-of-stock items will be made by crediting the Customer's bank account or by bank cheque addressed to the Customer's name at the billing address within 30 days from the payment of the price.
3/ Price
The prices of the products on our Site are indicated in euros, including VAT, governed by article 293 B of the French General Tax Code. They include VAT, handling, packaging and conservation costs for sugar-free products. They do not include shipping and delivery costs.
The Company REGIME CRETOIS reserves the right to modify its prices at any time, it being understood that the products will be invoiced on the basis of the rates in force at the time of the registration of the orders.
4/ Delivery
a/ Generalities
Orders placed on the Site: www. deliceslowcarb.com are delivered to the address communicated by the Buyer at the time of his/her order or in a relay point if this was his/her choice.
The Buyer is required to take all the necessary steps to ensure the proper delivery of his/her order, in particular to provide all the information required for delivery (accuracy of the address, etc). In the event of an erroneous or incomplete address, the costs of re-shipment shall be borne by the Buyer. Failing this, the Company REGIME CRETOIS shall in no case be held responsible for a delivery defect concerning its sugar-free products. In case of damage during transport, the claim must be made to the carrier within 3 days of delivery.
Different carriers are available for the delivery of your package. The delivery time is variable between the order and the reception of the parcel according to the selected deliverer (1 to 11 days). Any possible overrun of the delivery times provided by the carriers cannot give rise to damages, withholding or cancellation of the order. If the Buyer is absent on the day of delivery, the carrier will leave a notice in the letterbox indicating the place and date on which the Buyer can collect the package. Any delays cannot be attributed to our Company, which declines all responsibility for the time taken by the Buyer to collect his parcel. No damages or interest can be claimed. The aforementioned delays do not, moreover, give the Buyer the right to cancel the sale or to refuse the goods.
b/ Rates
For any order, the Buyer must pay shipping costs which differ according to the chosen carrier:
In metropolitan France:
- With DPD Predict Home Delivery by appointment (24-48h home delivery in the time slot that suits you best once the order in the state "shipped"(among choices offered by DPD). )
Single price €6 incl. VAT
- With DPD Pickup Relay Delivery (24-48h delivery in France to more than 5,000 Pickup Relays once the order is in the "shipped" state)
Single price: €4.60 incl. VAT
In Switzerland:
- DPD international delivery:
Single price: €19.20 incl. VAT
- UPS international:
Single price: €26.40 incl. VAT
In the European Union:
- International delivery by DPD:
One-off price: €6.60
- Colissimo international without signature:
One-off price: €9.60 inc:
In Colissimo without signature (Access):
- less than 3 kg: 30 €
- more than 3 kg: 45 €
c/ Delays
Orders made from Monday to Friday before noon will be prepared at D + 1. Orders placed after midday will be processed on D + 2.
Orders placed on Saturday or Sunday will be processed the following Monday. If they are placed on a public holiday, they will be processed on the next working day.
Once the parcel has been dispatched", the delivery time will be shortened according to the choice of the carrier (see section b)
d/ In case of problem in the delivery
When the parcel is handed over by the carrier (or when it is collected from a relay point), the Buyer must check the state of the packaging and the conformity of his order. For any complaint concerning a possible non-conformity, the Buyer must notify it by mail or by email to the Customer Service of the Company within 72 H following the reception of the parcel.
For any complaint concerning apparent defects concerning the sale of sugar-free products, a letter by registered mail with acknowledgement of receipt must be sent to us within 8 days following the reception. If the complaint is accepted by SARL REGIME CRETOIS, the Buyer may be reimbursed for the products ordered.
After the aforementioned deadlines, the order will be deemed accepted and the products compliant. In the event of a lost package, no compensation can be granted before the result of an investigation by the carrier.
After a period of 30 days from the shipment of your order, no claim will be taken into account by the SARL.
5/ Payment
Payment of orders made on the site: www.deliceslowcarb.com can be made by credit card for all products marketed on the said site.
The information transmitted allowing the payment is encrypted by a software securing the transaction, no third party will be able to take cognizance of these data.
To be valid, any order must be paid in full, failing this, it will lead to the cancellation of the delivery.
6/ Withdrawal
The Buyer does not have a withdrawal period except in the case of non-food products (specialised bookstore).
In fact, products that have a perishable nature (those with a consumption limit date) (article L.221-28 of the consumer code) cannot benefit from the withdrawal period
7/ Security
A data security system is installed on the site: SSL encryption allows the protection of sensitive banking data
Payment of orders is made through the Banque Populaire.
8/Intellectual property
All visuals, texts, photos, drawings, images, comments, visual or sound animations on the Site are subject to intellectual property rights and copyright and as such, any reproduction (exploitation, redistribution or use of any kind) is strictly forbidden in part or in full.
9/ Customer Service
Our customer service is at your entire disposal from Monday to Friday from 08H to 17H30.

10/ Responsibility:
All sugar-free products on the Site comply with current French legislation and the standards applicable in France.
The Buyer is invited to refer to the description of each product to know its characteristics (ingredients etc). In case of doubt or if he/she so wishes, he/she may contact the Customer Service (9/). The photos of the products are presented for information only. They are not contractual and cannot engage the responsibility of our Company in case of inaccuracies, omissions or errors in a general way.
11/ Legal guarantees of conformity
The Customer benefits from the legal guarantee of conformity of the good and hidden defects provided for in the legal provisions of articles 1641 and following of the Civil Code.
As such, defective products or products that do not correspond to those ordered may be reimbursed or exchanged under the following conditions: the products must be new, complete and in their original condition (accessories, packaging, etc.), accompanied by the original purchase invoice, it being understood that no product may be reimbursed/exchanged before the SARL has reshipped and received the products. 12/ Personal information
In order to allow the management of the orders of products without sugar placed by the Buyer and their good progress, the information in nominative matter concerning it is necessary and can be transmitted to our service of management of the orders, execution, treatment and payment.
The SARL reserves the right to collect this information including the use of the cookies. In accordance with the French Data Protection Act n°78-17 of 06/01/78, the Customer has the right to access, rectify and delete personal data concerning him/her. To do so, he/she need only write to our Company at the following address: 4 chemin de la Ménude 31770 Colomiers, specifying surname/first name/email and customer reference.

13/ Applicable law in the event of a dispute
The French language in which these GTCs are drafted constitutes the sole language of the parties. In this sense, French law is the only applicable law and the Commercial Court of Toulouse is the only competent court. An amicable solution must be sought as a priority, it being understood that good faith and the desire to find a solution is presumed for both parties.
